Public Utility Definition

An entity that is not a regulated utility that provides retail electric vehicle (EV) charging services is not defined as a public utility and may sell electricity if it is used for the purpose of fueling an EV. EV charging stations that are owned, operated, or maintained by retail electric suppliers may not be subsidized by any fee or charge associated with regulated service offerings. This does not restrict retail electric suppliers from subsidizing the costs of make-ready infrastructure through fees or charges for services so long as such subsidies offered to EV charging providers is nondiscriminatory.
