Electric Vehicle (EV) Charger Payment Regulations and Inspection Requirements

An EV charging station with a charging capacity of more than 50 kilowatts that charges a fee and became operational after Nov. 1, 2021, shall register with the Oklahoma Tax Commission. Operators of any such station shall make a full and conspicuous disclosure of the payment rate for charging at the site of the charging station, on a mobile software application, and on its website, if applicable. Rates may be charged in units per kilowatt-hour or by time elapsed. The metering system shall be capable of having an audit performed, and the Oklahoma Tax Commission or its delegate has the right to inspect charging stations. Failure to remit the EV charger tax may terminate the operator’s license.

The Oklahoma Corporation Commission has the authority to inspect EV charging stations or require third-party testing to ensure compliance with regulations. Violators may be subject to a fine of up to $500 per day, per violation. Additional requirements apply.
