Dealer Electric Vehicle (EV) and EV Charging Station Requirements

A manufacturer cannot require a dealer to buy or lease EV charging stations at the dealer’s expense unless the dealer’s franchise includes EV models or the dealer has notified the manufacturer that it will sell and service that manufacturer’s EVs. Any charger requirements must be reasonably related to projected EV sales and service in the dealer’s market, and manufacturers cannot require dealership chargers to be available for public use. Manufacturers may offer lump sum financial assistance to dealers that purchase or install EV charging stations.

If a manufacturer withdraws all or a material part of its EV distribution plan, it must accept returns or fully reimburse a dealer for EV-related parts, tools, equipment, chargers, and other required items if the dealer shows EV sales or service volume is insufficient to achieve a positive return over those items’ useful lives, and the dealer submits a written request within 24 months of receiving the items.
